Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of the Mauzy Weather website and mobile application (together, the “Service”), operated by 98895 NL Corp, carrying on business as Mauzy Weather (“Mauzy,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

The Service is provided by 98895 NL Corp, a corporation registered in Newfoundland and Labrador, Canada, operating under the trade name Mauzy Weather. You can reach us at hello@mauzyweather.ca.

2. What Mauzy is

Mauzy displays weather information sourced from Environment and Climate Change Canada (“ECCC”) and presents it alongside an overlay of Newfoundland and Labrador dialect, sayings, and cultural commentary. The underlying weather data comes from a third party; the language layer is our own creative and cultural expression. Mauzy is a cultural and entertainment product, not a meteorological, safety, or emergency service.

3. Entertainment purposes — no reliance

You acknowledge and agree that:

• the language layer (the sayings, phrasing, dialect, humour, and commentary) is provided for entertainment and cultural purposes only and is not a forecast, advisory, or any form of professional, safety, or weather advice;
• weather information can be incomplete, delayed, or inaccurate, and conditions can change quickly;
• you must always verify current conditions, forecasts, watches, and warnings with ECCC and other official sources before making any decision; and
• Mauzy is not intended to guide, instruct, or direct your daily activities, and you must not treat it as doing so.

Any reliance you place on the Service, and any action you take based on it, is strictly at your own risk.

4. Acceptable use

You agree to use the Service only for lawful purposes and not to: misuse, disrupt, or attempt to gain unauthorized access to the Service or its systems; copy, scrape, or redistribute its content except as expressly permitted; or use the Service in any way that infringes the rights of others. We may suspend or discontinue access to the Service, in whole or in part, at any time.

5. Submissions

If you submit a word, saying, or other content to us (for example, through our dialect submission form), you grant 98895 NL Corp a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, adapt, publish, and display that content in connection with the Service and its promotion, including within the app’s language layer. You represent that you have the right to share what you submit, and that it does not infringe anyone else’s rights. Please don’t submit confidential or sensitive personal information.

6. Intellectual property

The Service, including the Mauzy Weather name and trade-mark, the curated phrase library, the design, graphics, and software, is owned by 98895 NL Corp or its licensors and is protected by Canadian and international intellectual property laws. The underlying weather data is provided by ECCC under the Open Government Licence – Canada. Nothing in these Terms transfers any of our intellectual property rights to you.

7. Third-party data and services

The Service relies on third parties, including ECCC for weather data and various hosting and infrastructure providers. We do not control and are not responsible for the accuracy, availability, or content of third-party data or services, and their use may be subject to their own terms.

8. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties or conditions of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties and conditions, including those of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any weather information or commentary will be accurate, current, or reliable.

9. Limitation of liability

To the fullest extent permitted by applicable law, 98895 NL Corp, and its directors, officers, employees, and agents, will not be liable for any loss, injury, or damage of any kind — whether direct, indirect, incidental, special, consequential, or exemplary — arising out of or in connection with your use of, or inability to use, the Service, or your reliance on any weather information or language-layer content, even if we have been advised of the possibility of such damages. Mauzy cannot be held responsible for any decision you make or action you take based on the Service. Where liability cannot be excluded by law, our total aggregate liability is limited to the greater of the amount you paid us (if any) to use the Service, or CAD $50.

10. Indemnity

You agree to indemnify and hold harmless 98895 NL Corp and its representatives from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service or your breach of these Terms.

11. Changes to the Service and these Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the Province of Newfoundland and Labrador and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in Newfoundland and Labrador for any dispute arising out of or relating to these Terms or the Service.
